Welcome to Penchills! These Terms of Service (“Terms”) govern your access to and use of the Penchills website, mobile games (such as Get the flock out), digital art, comic books, and any other services provided by Penchills (“Services”).

Please read these Terms carefully before using our Services. By accessing, downloading, or playing our games, or browsing our website, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our Services.

1. Intellectual Property Rights

All content, designs, illustrations, graphics, scripts, games, animations, storylines, code, and trade dress on our website and in our games are the sole intellectual property of Penchills, unless otherwise stated.

  • No Unauthorized Reproduction: You may not copy, modify, distribute, publish, transmit, or reverse engineer any materials, comics, or game assets without our express prior written permission.
  • User-Generated Feedback: Any ideas, suggestions, or feedback you submit to us regarding our games, comics, or art are entirely voluntary and we may use them without any compensation or obligation to you.

2. End-User License Agreement (EULA)

Subject to your compliance with these Terms, Penchills grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access our website and download/play our mobile games solely for your personal, non-commercial entertainment purposes.

  • Restrictions: You agree not to exploit our games commercially, use cheats, automated software (bots), hacks, or any unauthorized third-party software to modify or interfere with the gameplay, or attempt to decompile or extract source code from our software.

3. In-App Purchases, Billing, and Subscriptions

Our mobile games may offer virtual currency, cosmetic items, power-ups, or subscriptions (“In-App Purchases”).

  • Third-Party Gateways: All billing, payment processing, subscriptions, and refunds are handled and processed directly by the distribution platforms (such as the Apple App Store). Penchills does not directly store, process, or have access to your payment card details.
  • Apple Store Terms: When purchasing content through Apple devices, you are subject to the Apple Media Services Terms and Conditions. Subscription management and cancellations must be done through your Apple ID settings.
  • Refund Policy: All In-App Purchases are final and non-refundable, except where required by law or processed under the platform provider’s refund framework (e.g., Apple Customer Support).

4. User Conduct and Account Security

Some of our services might allow you to create accounts, save progress, or submit scores. You are responsible for keeping your credentials confidential and are fully responsible for all activities that occur under your account.

  • Prohibited Actions: You agree not to engage in any toxic behavior, harassment, exploit bugs to gain unfair advantage, or act in a way that disrupts the enjoyment of other players.

5. Health and Safety Disclaimer

A very small percentage of individuals may experience epileptic seizures or blackouts when exposed to certain light patterns or flashing lights. Some of our video games feature colorful, fast-moving, or flashing comic-style graphics.

  • Precautionary Steps: Play in a well-lit room, take regular breaks, and consult your physician before playing if you or anyone in your family has an epileptic condition or history of seizures.

6. Disclaimer of Warranties

Our Services are provided on an “as-is” and “as-available” basis, without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

  • No Service Guarantees: Penchills does not warrant that our website or games will always be secure, completely error-free, uninterrupted, or free from viruses or other harmful components.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Penchills and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of or inability to use our services; (b) unauthorized access to our servers or third-party infrastructure; or (c) any conduct or content of third parties.

8. Governing Law and Jurisdiction

These Terms and any action related thereto will be governed by the laws of the province of Quebec and the federal laws of Canada applicable therein, without regard to its conflict of laws provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Quebec, Canada.

9. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. We will indicate the “Effective Date” at the top of this page when updates are made. Your continued use of our Services after any changes constitutes acceptance of the new Terms.
